This one-hour session will focus on the two activities within the Work Capability Assessment that are most relevant to claimants with sight loss and the importance of the substantial risk regulations.

The Work Capability Assessment features in claims for Employment and Support Allowance (ESA) and Universal Credit (UC). New claims for contribution-based ESA (called ‘new-style’ ESA) can still be made by people who have paid sufficient national insurance contributions. Current claims for ESA can still be superseded (someone in the work-related activity group can be re-assessed as meeting the criteria for the support group.)

Within UC, the work capability assessment is not only the route to change the conditionality of a UC claim, but it can also increase a UC claimant’s income either through the work allowance or the limited capability for work related activity element.
